Welcome to luminarkav.com (the "Website"), owned and operated by LuminarkAV, Shop No. 101, Plot No. 1, Abhinav Arcade, Abdul Kalam Azad Road, Abhyankar Nagar, Nagpur 440010, Maharashtra, India ("LuminarkAV", "we", "us", "our"). By browsing the Website or placing an order, you agree to these Terms & Conditions and to our Privacy, Shipping, Cancellation & Refund and Warranty policies, which form part of these Terms. If you do not agree, please do not use the Website.
1. Eligibility
You must be at least 18 years old and legally able to enter into a contract under the Indian Contract Act, 1872 to place an order. Business buyers placing orders on behalf of a company confirm that they are authorised to do so.
2. Products and information
- We sell professional audio, video, lighting, conferencing and musical instrument products. Product descriptions, specifications and images are taken from the manufacturer or prepared in good faith. Minor variations in colour, finish, packaging or accessories may occur, and manufacturers may change specifications without notice.
- Product images are for illustration. If a detail is important to your purchase, please contact us before ordering.
- It is the buyer's responsibility to ensure that the product is suitable and compatible with their system, venue or application. We are happy to advise, but advice given free of charge does not form part of the sale contract.
3. Prices and taxes
- All prices are in Indian Rupees (INR) and include GST unless stated otherwise. Freight charges are borne by the customer and are added at checkout or communicated before dispatch.
- Prices and availability may change without notice. The price payable is the price shown at the time your order is placed.
- If a product is listed at an obviously incorrect price or with incorrect information due to a technical or typographical error, we may cancel the order and refund the full amount you paid, even after confirmation.
- A GST tax invoice is issued for every order. Business buyers must enter their correct GSTIN and billing details at checkout; invoices cannot be changed after they are issued.
4. Orders and acceptance
- An order confirmation email or message only confirms that we have received your order. The contract is formed when we dispatch the product.
- We may decline or cancel an order (with a full refund) if the product is out of stock, the price or listing is incorrect, the order appears fraudulent, payment cannot be verified, or quantities exceed reasonable retail limits.
- Some products are sourced from the brand or distributor after you order ("special-order" items). Where this applies, the expected lead time is mentioned on the product page or communicated to you before dispatch.
5. Payment
We accept payments through secure third-party payment gateways (credit/debit cards, UPI, net banking, wallets) and direct bank transfer (NEFT/RTGS/IMPS). Orders paid by bank transfer are processed only after the amount is credited to our account. We do not store your card details. See our Secure Payment page for details.
6. Shipping, returns and warranty
Delivery, returns, cancellations and warranty are governed by our Shipping & Delivery Policy, Cancellation, Return & Refund Policy and Warranty Policy published on this Website.
7. Installation and professional use
Unless separately quoted, prices do not include installation, configuration, programming, cabling or site work. Professional equipment should be installed and operated by qualified persons in line with the manufacturer's instructions and local electrical safety rules. We are not responsible for damage caused by improper installation, unsuitable power supply, voltage fluctuation, or use outside the manufacturer's specifications.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for the product concerned. We are not liable for indirect or consequential losses such as loss of business, profit, data, event cancellation or hire costs. Nothing in these Terms limits any right you have under the Consumer Protection Act, 2019 that cannot be excluded.
9. Intellectual property
All content on the Website, including text, graphics, logos and layout, belongs to LuminarkAV or its licensors. Brand names and trademarks belong to their respective owners and are used only to identify products. You may not copy or reuse Website content for commercial purposes without our written permission.
10. Acceptable use
You agree not to misuse the Website, attempt unauthorised access, submit false information, or place orders for fraudulent or unlawful purposes. We may suspend accounts that breach these Terms.
11. Force majeure
We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, transport disruptions, government action, supply shortages from manufacturers, or courier delays.
12. Governing law and disputes
These Terms are governed by the laws of India. Subject to your statutory rights as a consumer, the courts at Nagpur, Maharashtra shall have exclusive jurisdiction.
13. Changes
We may update these Terms from time to time. The version published on the Website when you place your order applies to that order.
